1. Definitions

  • Casa El Girasol: The main villa with guesthouse, swimming pool, fenced grounds, inventory, and all facilities.
  • Lessor: The person or entity renting out the accommodation (Casa El Girasol).
  • Tenant: The person making the booking and their travel companions.
  • Rental Fee: The total amount for the rental period, including cleaning fees unless agreed otherwise.
  • Information: All written or electronic information about the accommodation, facilities, and rules.
  • Cancellation: Termination of the rental agreement in writing before the start date.
  • Applicability: These terms apply to all bookings. Verbal agreements are only valid if confirmed in writing (by email).


2. Reservation and Payment

  • The accommodation is available exclusively for recreational use.
  • The rental agreement is concluded only after written confirmation by the lessor.
  • A deposit of 25% is required within 30 days of the invoice date. For bookings within two months of arrival, the full amount must be paid within 7 days.
  • The booking is final once the deposit is received. The remaining balance must be paid at least 60 days before arrival.
  • Payment confirmations are sent by email.
  • Late payment is considered a cancellation, and cancellation fees apply as described below.


3. Youth Groups and Pets

  • No youth groups allowed. The main tenant must be at least 25 years old.
  • Pets are not permitted in the accommodation.


4. Prices

  • Rental prices include water, electricity, internet, bed linen, and towels. Cleaning fees are not included.
  • Excessive energy use is charged at €0.25 per kWh. Meter readings are taken at check-in and check-out.
  • For more than 10 guests (up to 12 max), a surcharge of €20 per person per night applies.


5. Cancellation Policy

  • Cancellations must be made in writing (by email) and are only valid after confirmation by the lessor.
  • The following cancellation fees apply:
  • Up to 3 months before arrival: Free cancellation.
  • Up to 2 months before arrival: 30% of the rental fee.
  • Up to 1 month before arrival: 50% of the rental fee.
  • Less than 1 month before arrival: 95% of the rental fee.
  • On or after the arrival date: Full rental fee (no refund).
  • Early departure does not entitle you to a refund of the rental or cleaning fees.
  • We strongly recommend purchasing travel or cancellation insurance.

6. Arrival, Departure, and Deposit

  • Check-in: From 3:30 PM on the day of arrival.
  • Check-out: Before 10:00 AM on the day of departure.
  • A final inspection will take place before departure; please inform the lessor of your departure time at least one day in advance.
  • Before departure:
  • Dispose of all waste in the designated containers outside.
  • Clean the kitchen, empty and run the dishwasher, and put everything away.
  • Empty the refrigerator and remove perishable foods.
  • Remove all bed linen and towels and place them at the bottom of the stairs.
  • Return all furniture to its original position.
  • Leave the garden, terrace, and outdoor areas tidy.
  • Report any damages before departure.
  • Deposit and Refund: The security deposit will be refunded within 7 days if the accommodation is left in good condition. Any extra cleaning, repairs, or replacements will be deducted from the deposit.
  • Early departure: No refund for early departure.


7. Tenant Obligations

  • Tenants must use the accommodation responsibly and avoid causing nuisance to neighbors or damage to the property.
  • Any damage must be reported within 24 hours by email or phone. Repair costs will be deducted from the deposit.
  • Smoking is strictly prohibited inside the house and guesthouse. Smoking inside will result in a €100 cleaning fee, deducted from the deposit.
  • Alterations to the property, such as digging or pruning, are not allowed.


8. Liability

  • The use of the accommodation is at your own risk. The lessor is not responsible for loss, damage, or theft of personal belongings.
  • The lessor is not liable for force majeure situations (e.g., severe weather, utility outages).
  • The lessor will make reasonable efforts to resolve any issues as quickly as possible.


9. Force Majeure

  • In the event of force majeure, the lessor may terminate the agreement without compensation.
  • If force majeure limits your stay, the agreement will be proportionally adjusted


10. Disputes and Applicable Law

  • Dutch law applies to all bookings and disputes.
  • Only the court in Den Bosch (Netherlands) has jurisdiction over disputes.
